Release and Waiver of Liability & Indemnity Agreement

Cutting Edge Theater, LLC

(Read Carefully Before Signing)

In consideration of being permitted to participate in any way at Cutting Edge Theater indicated below and/or being permitted to enter the designated rehearsal/performance area, the parent(s) and/or legal guardian(s) of the minor participant named below agree:

1. The parent(s) and/or legal guardian(s) will instruct the minor participant that prior to participating in the below performing arts activity or event, he or she should inspect the facilities and equipment to be used, and if he or she believes anything is unsafe, the participant should immediately advise the officials of such condition and refuse to participate. I understand and agreed that, if at any time, I feel anything to be UNSAFE, I will take all precautions to avoid the unsafe area and REFUSE TO PARTICIPATE further.

2. I/We fully understand and acknowledge that:

a. There are risks and dangers associated with participation in Dance/Theater events and activities, which could result in bodily injury, partial and/or total disability. Paralysis and death.

b. The social and economic losses and/or damages, which could result from these risks ad danger, described above, could be severe.

c. These risks and dangers may be caused by the action or negligence of the participant or the action, inaction or negligence of others, including but not limited to, the Releases named below.

3. I/We accept and assume such risks and responsibility for the losses and/or damages following such injury, disability, paralysis or death, however caused and whether caused in whole or in part by the negligence of the Releases named below.

4. I/We HEREBY RELEASE, WIAVE, DISCHARGE AND COVENANT NOT TO SUE Cutting Edge Theater, LLC, including its owners, managers, promoters, instructors, the studio allowing use of the premises to conduct the dance/theater event or program, consultants and others who give recommendations, directions, or instructions to engage in risk evaluation or loss control activities regarding the facility or events held at such facility and each of them, their directors, officers, agents, employees, or others associated with Cutting Edge Theater, LLC, all for the purposes herein referred to as “Release”… FROM ALL LIABILITY TO THE UNDERSIGNED, my/our personal representatives, assigns, executors, heirs, and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES AND ANY CLAIMS OR DEMANDS THEREFORE ON ACCOUNT OF ANY INJURY, INCLUDING BUT NOT LIMITED TO THE DEATH OF THE PARTICIPANT OR DAMAGE TO PROPERTY, ARISING OUT OF OR RELATING TO THE EVENT (S) CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEE OR OTHERWISE.

5. I/We HEREBY acknowledges that THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and involve the risk of serious injury and/or death and/or property damage. Each of THEUNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES.

6. EACH OF THE UNDRSIGNED further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the event is conducted and that is any portion is held invalid, it is agrees that the balance shall, notwithstanding continue in full legal force and effect.

7. On behalf of the participant and individually, the undersigned parent(s) and/or legal guardian(s) for the minor participant executes the Waiver and Release, if, despite this release, the participant makes a claim against any of the Releases, the parent(s) and/or legal guardian(s) will reimburse the Release for any money which they have paid to the participant, or on his behalf, and hold them harmless.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANCIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.


Photo Release

I understand that photos and videos are occasionally taken at Cutting Edge Theater, LLC rehearsals and performances. I consent that the photographs, audio, or video, taken of my child may be used by Cutting Edge Theater, LLC, its assigns or successors, in whatever way they desire, including, but not limited to publicity purposes, web page, and external publications: furthermore, I hereby consent that such photographs and videos shall be the ole property of Cutting Edge Theater, LLC, and they shall have the right to duplicate and make other uses for such information as they desire free and clear of any claim whatsoever on my part.

Consent for Treatment

I hereby give my consent to have my child/children treated by emergency medical personnel, a physician, or surgeon, in case of sudden illness or injury while participating in Actin Up At CECA. It is understood that neither the Organizer nor the Venue will provide medical insurance for such treatment, and that the cost thereof will be at my expense. I have read and understood the foregoing registration liability release and parental consent form, and agree to all of its terms and conditions

Mandatory Parent Meeting

Parents of all cast members must attend the Parent Meeting where you will receive important information critical to the success of your cast member and show.


Parent Participation

One parent per family is required to fulfill one of our volunteer positions listed on your Audition sheet. A parent must also

help with the “strike” (breakdown, cleanup and loading) of the set after the final performance.


Check Communication Channels

All communication is done via FACEBOOK. Parents must commit to checking their FACEBOOK for any changes and updates regarding the production. An accurate FACEBOOK address must be provided.


Costumes

Cast members will be required to provide their own costumes or pay a costume rental fee. We make every effort to keep costs to a minimum and to allow flexibility and creativity. Specific items may be required.


Absences

Attendance is very important. Cast members cannot miss their scheduled featured rehearsals. Due to limited rehearsal time we will not be able to go back and re-teach or re-stage scenes for students who are absent. If a cast member misses a rehearsal, they may not be placed in that particular number. A detailed schedule will be given out in advance. It is extremely important that you keep track of the schedule and which days your character is scheduled to stay late. Mark any conflicts you may have and present them with your registration packet in advance. Tech week (the week of the performance) will be all day and into the evening rehearsals. Attendance is mandatory. There can be no absences. Missing a mandatory rehearsal will result in consequences for that participant.


Additional Rehearsals and Schedule Changes

Additional rehearsals and changes are very rare, but may be scheduled as needed. We will make every effort to give you plenty of notice in advance.


Dismissals

Disruptive students will be asked to sit out of rehearsal and will not be eligible to participate in the number being taught. Any student whose behavior is deemed inappropriate by staff will be dismissed from the workshop without a refund of the registration fee. Cast members and their parents must be aware that rehearsals can be strenuous and require cast members to have the ability to focus for up to 90 minutes at a time.

Parent Volunteer Positions

Parent Volunteer Positions 


Rehearsal Monitor: Attend the General Rehearsal Session to monitor cast member behavior, keep noise levels down, facilitate clean up after rehearsal and make sure everyone gets picked up safely after rehearsal ends. You will work as part of a scheduled team.


Publicity: Write press release. Assemble a team and coordinate the distribution and placement of flyers, posters, put together a Facebook event and post on face book


Sets: Help put together and paint set pieces and backdrops for the show.


Props: Shop for and/or create needed set pieces.


Cast Party Coordinator: Secure a venue for the cast party at the end of the run. Organize food, beverage, and entertainment. Make flyers for cast. Collect funds (or food items).


Costume Coordinators: Meet with production staff to help design costumes. Help advise families on costume ideas and how to create or find them. If a general costume is required for the entire cast or a certain group of kids, determine the costume and instruct parents how to make or purchase the needed items; or collect money to purchase/ make the items for them.


House Manager: Responsibilities include ensuring the safety and comfort of the audience during the performances, liaising with backstage, box office and ushers before and during performances, and helping to solve any problems that may arise with the front of the house.


Backstage Coordinator: Be at all tech rehearsals to take notes on what cast members will need help with backstage to ensure a successful run. Assigns backstage monitors specific duties (props, quick changes, set changes) and ensure all performers safety, respectful behavior, noise control, and meeting cues at the proper time.


Backstage Crew: Work in the wings to assist cast members and move set pieces and scenery.


Performance Monitors: Ensure performers safety, respectful behavior and noise control during tech week and before and during performances. May be asked to assist with costume and set changes if necessary.


Concessions/Cast Souvenirs: Sell refreshments and show memorabilia before, during and after each performance. Select and purchase concessions items.


Usher: Make sure the front of house is ready for the audience. Fold programs. Preset VIP reserved seat placeholders. Collect tickets and hand out programs before the show. Clean and straighten out all theater seating before the show.


We are asking each family to fulfill at least one volunteer position.
