Liability Waiver, Indemnity, and Media Release Agreement
In consideration of being permitted to participate in auditions, rehearsals, performances, and any related activities (the "Event") at Cutting Edge Theater, LLC, and/or being permitted to enter the designated rehearsal or performance areas, I hereby agree to the following terms:
1. Inspection of Facilities
I agree that prior to participating in any performing arts activity or event, I will inspect the facilities and equipment to be used. If I believe anything to be unsafe, I will immediately advise theater officials of the condition, take all necessary precautions to avoid the unsafe area, and refuse to participate further until the condition is resolved.
2. Acknowledgment of Risk
I fully understand and acknowledge that:
a. There are inherent risks and dangers associated with participation in dance, theater, and stage events, which could result in bodily injury, partial and/or total disability, paralysis, or death.
b. The social and economic losses and/or damages resulting from these risks could be severe.
c. These risks and dangers may be caused by my own actions or negligence, or by the actions, inactions, or negligence of others, including the Releasees named below.
d. I expressly acknowledge that any injuries received may be compounded or increased by negligent rescue operations or procedures of the Releasees.
3. Assumption of Risk
I knowingly and freely accept and assume all such risks, both known and unknown, and assume full responsibility for any losses, costs, and/or damages following any injury, disability, paralysis, or death, however caused, and whether caused in whole or in part by the negligence of the Releasees named below or otherwise.
4. Release and Covenant Not to Sue
I hereby release, waive, discharge, and covenant not to sue Cutting Edge Theater, LLC, its owners, managers, promoters, instructors, staff, independent contractors, landlords, or host studios permitting the use of their premises, as well as their directors, officers, agents, and employees (collectively referred to as "Releasees"), from all liability to myself, my personal representatives, assigns, executors, heirs, and next of kin.
This release applies to any and all claims, demands, losses, or damages on account of any injury—including but not limited to death or property damage—caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, arising out of or relating to my participation in the Event.
5. Severability
I expressly agree that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the law of the State or Province in which the Event is conducted. If any portion of this agreement is held invalid or unenforceable, it is agreed that the balance shall continue in full legal force and effect.
6. Indemnification
I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, demands, losses, or lawsuits, including attorney's fees, brought by myself or on my behalf by any third party, arising out of or related to my participation in the Event.
7. Media and Photo Release
I understand that photographs, audio recordings, and video footage are regularly taken during Event activities.
a. I grant Cutting Edge Theater, LLC, its legal representatives, assigns, and successors, the irrevocable right to use, publish, and distribute photographs, audio, or video taken of me for promotional materials, publicity, website content, social media, marketing, and external publications.
b. I agree that all such media is the sole property of Cutting Edge Theater, LLC, which retains the right to duplicate, edit, or modify these materials free and clear of any claim or compensation whatsoever on my part. I waive any right to royalties or financial remuneration arising from the use of these images or recordings.
Acknowledgment of Understanding
I have read this comprehensive Liability Waiver, Assumption of Risk, Indemnity, and Media Release Agreement. I fully understand its terms, understand that I have given up substantial rights by signing it, and agree to all clauses herein. I have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me, and intend my signature to be a complete and unconditional release of all liability and grant of media rights to the greatest extent allowed by law.
